As part of its legal action against apple in the United States, Epic Games has asked numerous Apple executives to testify. Scott Forstall, Apple's former IOS senior vice president, is one of the executives likely to face testimony in Epic Games' app store lawsuit,But Apple said it was difficult to reach him.
Although figures such as CEO Tim Cook are available to testify at any time, not everyone can do so, according to a document filed by the Northern District Court of California on Monday. In an update of the stakeholder testimony filed with the court, epic told apple that it had difficulty contacting Scott Forstall.
According to epic, apple asked Scott Forstall to testify on December 15 and later confirmed on December 29 that Apple would provide evidence on behalf of the executive. Epic did not try to contact Scott Forstall for evidence. The company said Apple had changed its tune, saying it had never said it needed to force Scott Forstall to testify.
On February 5, 10 days before the discovery, apple said Scott Forstall had not responded to his request to testify on February 11. When epic asked for Scott Forstall's contact information, Apple was said to have provided a post office box and a twitter account. Apple also apparently said it wasn't authorized to share Scott Forstall's phone number, but later said it didn't have the details, according to epic.
Epic then asked Scott Forstall to testify after February 15, which Apple appears to have agreed to and set a deadline of March 10. Apple did not object to Scott Forstall's testimony to epic's charges until March 10. In addition, apple said it wanted its lawyers to testify on behalf of Scott Forstall, and that it never forced Scott Forstall to testify.
Apple said the two sides were working together to solve the problem and wanted to avoid judicial intervention. Currently, the trial is expected to take place in May 2021. Scott Forstall's last significant public appearance was in May 2020, when he was interviewed remotely via live video. Scott Forstall's Twitter account was last updated on October 29 last year.
